WHAT HAPPENED: A proposed law in Oklahoma would make it illegal to refuse to take a breathalyzer test. In addition, the law strips away part of the appeals process for DUI suspects. The law also forces suspects to choose between installing an ignition interlock system on their cars or await the outcome of their court case before getting their license back.
WHY IT MATTERS: The law may not be constitutional. Rights to due process and an appeals process are guaranteed by the Constitution. There are also concerns that those falsely accused of driving under the influence have no legal recourse to get their licenses back.
